17. Logistics point and return address

Orders may be prepared and shipped from the following logistics point:

This address differs from the company's registered office.

Returned products must be shipped to the address indicated in the return instructions provided to the customer. Please do not send products before registering the return request.

18. Transfer of risk

For orders placed by consumers, the risk of loss or damage to the products passes to the customer when the customer - or a person designated by them, other than the carrier - takes physical possession of the products.

If the customer independently chooses a carrier not proposed by us, the risk may pass to the customer upon handover of the product to the chosen carrier, in accordance with applicable law.

Ownership of the products may remain with ORIGINAL DECOUVERTE SRL until full payment of the price, to the extent permitted by law.

19. Parcel inspection

We recommend inspecting the parcel and the products as soon as possible after delivery.

If you notice:

• damage;
  
• missing products;
  
• a product different from the one ordered;
  
• defects;
  
• severely damaged packaging,

Prompt reporting helps us analyze the situation and file a claim with the carrier.

Failure to make an immediate claim does not waive the consumer's statutory rights regarding lack of conformity.

20. Right of withdrawal

Consumers who purchase online generally benefit from the right to withdraw from the contract within 14 calendar days without providing a reason, subject to statutory exceptions.

ORIGINAL DECOUVERTE SRL additionally offers a 30-day commercial return period, subject to the terms of the Return and Refund Policy.

The procedure, timeframes, costs, and exceptions are outlined in the Return and Refund Policy, which forms part of this contract.

The commercial return right granted for the period between day 15 and day 30 does not limit the statutory right of withdrawal or rights regarding defective or non-conforming products.

21. Order cancellation

The customer may request the cancellation of an order prior to its shipment.

The request must be sent as soon as possible to:

We cannot guarantee cancellation if the preparation or shipment of the order has already commenced.

If the product has been shipped, the customer may exercise the right of withdrawal or use the return procedure, provided the applicable conditions are met.

We reserve the right to cancel orders in the situations specified in the section regarding order acceptance.

22. Product conformity and statutory warranty

ORIGINAL DECOUVERTE SRL is responsible for delivering products that conform to the contract.

Products must, as applicable:

• match the description;
  
• possess the ordered quantity and quality;
  
• be suitable for normal use;
  
• possess the promised functionality and characteristics;
  
• be delivered with the necessary accessories and instructions;
  
• comply with legal safety and conformity requirements.

Consumers benefit from the statutory warranty of conformity provided for by applicable legislation.

For new goods, the seller is liable for non-conformities discovered within the statutory period starting from the date of product delivery.

In the event of non-conformity, the consumer may benefit, under the conditions prescribed by law, from:

• repair of the product;
  
• replacement of the product;
  
• a proportionate reduction in price;
  
• termination of the contract and reimbursement of the price.

Repair or replacement must be carried out free of charge, within a reasonable time, and without significant inconvenience to the consumer.

The consumer may not request termination of the contract when the non-conformity is minor, under the conditions prescribed by law.

Commercial warranties offered by the manufacturer or seller supplement, and do not replace, the statutory warranty of conformity.

23. Proper use of products

The customer must use the products:

• for their intended purpose;
  
• in accordance with the instructions;
  
• in compliance with safety warnings;
  
• using the appropriate voltage and accessories;
  
• without unauthorized modifications or interventions.

To the extent permitted by law, the warranty does not cover damage caused exclusively by:

• improper use;
• accidents or impacts;
  
• negligence;
  
• incorrect installation;
  
• unauthorized interventions;
  
• failure to follow instructions;
  
• normal wear and tear.

This provision does not limit the customer's rights when the damage is caused by a product defect, inadequate instructions, or a lack of conformity existing at the time of delivery.

24. Product safety and recalls

If we become aware that a product may pose a health or safety risk, we may:

• contact affected customers;
  
• issue warnings;
  
• request that use of the product be discontinued;
  
• arrange for repair, replacement, or return;
  
• cooperate with the manufacturer and competent authorities.

The customer must comply with reasonable instructions communicated in the event of a recall or safety alert.

25. Reviews and user-generated content

You may submit reviews, photos, videos, or other materials, provided that they:

• are lawful;
  
• do not infringe upon the rights of others;
  
• do not contain false or misleading information;
  
• do not contain malicious software;
  
• are not discriminatory, threatening, or defamatory;
  
• do not contain the personal data of others without permission.

By submitting content, you grant us a non-exclusive, worldwide, royalty-free, and transferable license to use it for the purposes of store administration, product promotion, and commercial communication, for the duration permitted by law.

This license does not allow us to misrepresent the customer's identity, statements, or experience.

You may request the removal of content to the extent that applicable law grants you this right.

26. Intellectual property

The content of the store, including:

• names;
  
• trademarks and logos;
  
• texts;
  
• graphic elements;
  
• photographs;
  
• videos;
  
• design;
  
• databases;
  
• code;
  
• advertising materials,

belongs to ORIGINAL DECOUVERTE SRL, its suppliers, or its licensors, and is protected by applicable law.

Use of the site for personal, non-commercial purposes is permitted.

Without our written consent, the following are prohibited:

• systematic copying of content;
  
• republication;
  
• commercial distribution;
  
• modification;
  
• automated data extraction;
  
• use of trademarks in ways that may cause confusion;
  
• use of images and videos in commercial campaigns.

Mandatory rights, legal exceptions, and uses permitted by law remain unaffected.

The store may use or provide access to services operated by third parties, such as:

• courier companies;
  
• analytics services;
  
• advertising platforms;
  
• parcel tracking applications;
  communication tools.

Use of these services may be subject to the providers' own terms and conditions.

We do not exclude liability for the negligent selection or integration of a provider where the law assigns us such responsibility.

The site may contain links to external services.

We do not control the content, availability, or practices of these sites.

Accessing them is subject to their own terms and conditions; however, this clause does not limit our liability regarding misleadingly presented links or our statutory obligations.

30. Relationship with Shopify

Shopify provides the technical infrastructure used to operate the store.

The sales contract is concluded between the customer and ORIGINAL DECOUVERTE SRL, not between the customer and Shopify.

Shopify is not the seller of the products and is not responsible for:

• product conformity;
  
• delivery;
  
• returns;
  
• refunds;
  
• warranties;
  
• our customer service.

The processing of personal data via the Shopify platform is described in our Privacy Policy and in the applicable Shopify documents.

31. Data protection

Personal data is processed in accordance with the Privacy Policy.

The policy describes, among other things:

• the purposes of processing;
  
• the legal grounds;
  
• service providers;
  
• cookies and similar technologies;
  
• the use of Shopify and TikTok;
  
• international transfers;
  
• retention periods;
  
• data subject rights.

32. Limitation of liability

ORIGINAL DECOUVERTE SRL is liable for damages caused by the non-performance of its obligations, within the limits prescribed by applicable law.

To the extent permitted by law, we are not liable for losses that:

• were not reasonably foreseeable at the time the contract was concluded;
  
• result exclusively from improper use of the product;
  
• are caused exclusively by incorrect information provided by the customer;
  
• are caused by unavoidable external events, as defined by law;
  
• represent business losses suffered by a customer who does not qualify as a consumer.

Nothing herein excludes or limits liability for:

• death or personal injury caused by fault;
  
• fraud;
  
• gross negligence;
  
• intentional breach of obligations;
• defective products, in cases where liability cannot be excluded;
  
• violation of statutory consumer rights;
  
• any other liability that cannot be excluded by law.

No limitation applies to consumers that would reduce the protection afforded by mandatory legal provisions.

33. Force Majeure

We are not liable for any delay or failure to perform obligations caused by a force majeure event or an external circumstance beyond our reasonable control.

Such events may include:

• natural disasters;
  
• fires;
  
• floods;
  
• wars;
  
• riots;
  
• general strikes;
  
• epidemics;
  
• major infrastructure disruptions;
  
• actions taken by authorities;
  extraordinary logistical blockages.

We will take reasonable measures to mitigate the effects and will inform affected customers.

If performance becomes impossible or is significantly delayed, the customer may be entitled to cancellation and a refund in accordance with the law.

34. Suspension or Termination of Access

We may suspend or terminate a user's access to the site if they:

• seriously violate these Terms and Conditions;
  
• attempt to defraud the store;
  
• compromise system security;
  
• infringe upon the rights of other users.

Any such measure must be reasonable and proportionate.

Termination of access does not affect:

• orders already accepted;

35. Severability

If any provision is declared void, illegal, or unenforceable, it shall be interpreted or removed only to the extent necessary.

36. Non-exercise of a Right

Failure to exercise a right immediately does not constitute a waiver of that right.

Any waiver must be express and applies only to the specific situation for which it was granted.

37. Assignment

The client may not transfer contractual rights or obligations to another person without our consent, except in situations permitted by law.

We may transfer the contract or the business to another entity only in compliance with the law and without diminishing the client's rights.

In the event of a transfer that significantly affects the client, the client will be informed to the extent required by law.

38. Amendment of Terms and Conditions

We may update these Terms and Conditions for:

• introduction of new features;
  
• clarification of provisions;
  
• operation hanges.

The version applicable to an order is the one accepted at the time the order was placed and accepted.

Subsequent changes will not retroactively alter contracts already concluded, except in situations required by law or agreed upon by the parties.

39. Governing Law

These Terms and Conditions are governed by Romanian law.

If you are a consumer habitually residing in another European Union state, this choice does not deprive you of the protection afforded by the mandatory rules of the state where you reside, where applicable.

Consumers from other European Union Member States may contact the competent authorities or bodies in their state of residence.

Any dispute shall be resolved by the competent courts in accordance with applicable law.

The consumer is not obliged to file a claim exclusively at the merchant's registered office and benefits from the jurisdictional rules applicable to contracts concluded with consumers.

The contract consists of:

• the Delivery Policy;

• any special promotion conditions.

In the event of a contradiction, the mandatory provisions of consumer protection legislation shall prevail.

Special conditions communicated and accepted for a specific order may prevail over general clauses, without diminishing statutory rights.
